Terms and Conditions – Sol Gardens

1. Quotations

• All quotations are valid for 30 days from the date of issue, unless otherwise stated.

• Prices are based on the information available at the time of the quotation.

• Any work not explicitly mentioned in the quotation is considered additional work (extra services) and will be invoiced separately.

2. Additional Work and Extra Costs

• If, during execution, it becomes clear that extra work is required (such as additional employees, work hours, licenses, or materials), this will be treated as additional work.

• Whenever possible, additional work above 500,- euro will be discussed with the client in advance, but this may not always be feasible in urgent or unforeseen situations.

• The client is required to cover the reasonable costs of all additional work.

3. Payment and Deposit

• The job will be scheduled only after receiving a 50% deposit of the quoted total.

• The remaining balance will be invoiced upon completion, with a payment term of 7 calendar days, unless otherwise agreed.

• Invoices for additional work must be paid within 30 calendar days.

• If payment is not received by the due date, a reminder will be sent. If payment remains outstanding after 14 days, we reserve the right to initiate collection proceedings. Any associated costs will be borne by the client.

4. Retention of Ownership

• All materials, plants, and services remain the property of Sol Gardens until full payment has been received.

5. Liability

• Sol Gardens is not liable for any damage resulting from incorrect or incomplete information provided by the client.

• We are only liable for direct damage resulting from intent or gross negligence.

6. Force Majeure

• In cases of force majeure (such as extreme weather, illness, or supply issues), we reserve the right to postpone or reschedule the work.

7. Cancellation

• If the client cancels the job after payment of the deposit, the deposit will not be refunded.

• If the cancellation occurs less than 48 hours before the scheduled start date, 75% of the total quoted amount will be charged.

8. Legal Disputes

• Any disputes arising from these terms or the services provided shall be subject to the jurisdiction of the court of Coín, Málaga, Spain.
